In August 2022, the OFCCP notified federal contractors of a Freedom of Information Act (FOIA) request for federal contractors’ EEO-1 reports.  The request was for consolidated Type 2 (company-wide) EEO-1 data from years 2016-2020 for all federal contractors.  Contractors were given the opportunity to object to having their EEO-1 reports released.  The OFCCP released the EEO-1 data of nearly 20,000 federal contractors on April 17, 2023.

In December 2023, a judge ruled that the Department of Labor (DOL) had until February 20, 2024 to either release the remaining EEO-1 reports for federal contractors who objected or appeal this decision.  In response, the DOL filed an emergency motion on February 15, 2024 to stay the deadline pending appeal.  Release of the rest of the data is temporarily on hold, but an order will likely be issued by the court soon to resolve the matter.  We will keep you updated on further developments.
