The OFCCP’s Contractor Portal remains open beyond the original June 30, 2022 deadline, the OFCCP announced on July 28.  The Contractor Portal is a new OFCCP platform where covered federal contractors and subcontractors must certify, on an annual basis, whether they are meeting their requirement to develop and maintain annual Affirmative Action Programs (AAPs).

Companies were able to send questions using the OFCCP’s Contractor Portal Technical Help Request Form.  The OFCCP received many questions about login issues and have been slow to respond.  The OFCCP is still in the process of resolving login issues.  Therefore, companies will not be penalized for filing late if they contacted the OFCCP for assistance by June 30.  However, companies who certify after June 30 may be prioritized for OFCCP audits if they failed to contact the OFCCP for assistance prior to the deadline.

The OFCCP also announced that “contractors that have not certified compliance by September 1, 2022, will be included on a list provided to federal agency contracting officers. The purpose of this list is to enable contracting agencies to notify contractors of their certification obligations, thereby assisting OFCCP in securing compliance.”
