The California Civil Rights Department (CRD) recently updated their FAQs page to state that the CRD will begin accepting “enforcement deferral requests” from employers for their Labor Contractor Employee Reports. If granted, employers have until July 10th, 2023, to submit the report.

Previously, we reported California requires employers with 100 or more employees to submit annual pay data reports for payroll employees and, new this year, labor contractor (i.e., staffing agency) employees. The deadline for submitting the payroll and labor contractor reports is May 10th, 2023. The CRD will only consider extension requests from employers already registered in the pay data reporting portal and will only accept requests through the portal. The extension is only for the Labor Contractor Employee reports, not the regular Payroll Employee reports.
