The OFCCP issued a new directive concerning the use of Predetermination Notices (PDN) during compliance reviews.  This directive is effective as of February 27, 2018.  A PDN is a letter given to federal contractors before the Notice of Violation (NOV) if the OFCCP has preliminary findings of violations.  However, a PDN was usually only provided in systemic discrimination cases.  The directive states that the PDN will be consistency given in cases of individual and systemic discrimination.  This is part of a larger effort to improve transparency with federal contractors.
