In reference to our previous article about this new requirement due March 31, 2021, the California Department of Fair Employment and Housing (DFEH) updated its FAQs.  The DFEH are still in the process of adding information to this webpage, so there is more information to come.  One important update to the FAQs is: “When reporting to DFEH, employers must include their employees assigned to California establishments and/or working within California, and employers may include their other employees. Thus, DFEH expects that a single-establishment employer in California will include on its pay data report all employees (including any employees outside of California) whether or not teleworking.”  This is relatively good news for California based companies because it appears they will not be required to report all employees outside of the state.
